About the talk
The idea of a judicial dialogue between constitutional courts and the use of foreign precedents in constitutional adjudication gained momentum in the last decades and fostered a vigorous academic debate around the theme. Both in Brazil and the US, the use of foreign precedents is a matter of great debate. Based on the comparison of historical contexts between Brazil and the US, the aim is to discuss the cases in which the Federal Supreme Court of Brazil uses the American political-legal scenario, in the form of precedents of the US Supreme Court, in order to support its interpretation and definition of the values extracted from the Brazilian Constitution. What are the current trends in this issue? What kind of arguments are being employed in favor or against the use of foreign law in these Courts and countries?

Bruno Cunha is a City Attorney in Recife, Brazil, and a Professor of Law. He is currently a PhD Candidate at the Federal University of Pernambuco (Brazil) and a Visiting Scholar at The Ohio State University Moritz College of Law. He holds an LL.B. from the Federal Univeristy of Santa Catarina (UFSC, Brazil), a Master of Laws from the University of São Paulo (USP, Brazil) and an LL.M. from the University of Michigan Law School.
